How much severance am I entitled to in South Africa?
At least one week’s remuneration for each completed year of continuous service under Section 41 of the BCEA. Partial years round down.
What counts as remuneration?
Gross basic salary plus regular cash allowances and employer contributions to medical aid and retirement. Using basic salary alone is the most common employer error.
How long do I have to refer a dispute to the CCMA?
Thirty days from the date of dismissal for an unfair dismissal dispute. Severance amount disputes follow a separate route under Section 41(6).
Does the CCMA cost anything?
No. The process is free and you do not need legal representation.
How much does UIF pay?
Between 38% and 60% of your average monthly salary for up to 238 days. Apply within six months of your last day.
Does severance affect my UIF?
No. They are entirely separate entitlements and you can claim both.
How is my leave payout calculated?
Remaining leave days multiplied by monthly salary divided by 21.67. Using 30 as the divisor understates it.
When must I receive my final pay?
Within seven days of termination or on the next scheduled pay date, along with your certificate of service and IRP5.
Is the severance minimum changing?
The Labour Law Amendment Bill, 2025 proposes raising it from one week to two weeks per year, but it is not yet in force.
