How is severance calculated in Tanzania?
At least seven days’ basic wage per completed year, up to a maximum of ten years — gross monthly salary divided by 26, times seven, times years capped at ten.
What does the ten-year cap mean?
The cap is on years counted, not on the amount, so an employee with 18 years receives the same as one with 10.
How long must I have worked to qualify?
At least one completed year of service with the employer.
When is severance not payable?
On termination for misconduct, on retirement, where a fixed-term contract expired automatically, or where reasonable alternative employment was unreasonably refused.
What else is owed on termination?
Remuneration for work done, annual leave pay for untaken leave, leave pay accrued during an incomplete cycle, transport allowance, and a certificate of service.
How much annual leave am I entitled to?
At least 28 consecutive days per leave cycle, inclusive of any public holiday falling within the period.
How much sick leave is there?
A hundred and twenty-six days per leave cycle with a medical certificate — full pay for the first 63 days, then half pay.
Who must prove a termination was fair?
The employer. Termination is unfair if they fail to prove the reason was valid and related to conduct, capacity, compatibility or operational requirements.
Where do I take a dispute?
The Commission for Mediation and Arbitration, then the Labour Division of the High Court.
