What is security of tenure?
Any worker performing core-business work who reaches twelve months and one day of continuous service becomes a regular employee by operation of law.
Does my contract label decide my status?
No. Courts apply the four-fold test, and statutory benefits follow the nature of the relationship rather than the label.
How is 13th month pay calculated?
One-twelfth of the total basic salary earned during the calendar year, paid on or before December 24 with a DOLE compliance report by January 15.
Do probationary employees get 13th month pay?
Yes. All rank-and-file employees are entitled, whether full-time or still on probation.
Is 13th month pay taxed?
The first ₱90,000 of 13th month pay and other benefits is tax-exempt.
Is separation pay automatic?
No. Dismissal for just cause generally carries none. Authorised causes — redundancy, retrenchment, closure, disease — do carry it, at rates that differ by cause.
How often must I be paid?
At least twice a month. Employers cannot pay less frequently than semi-monthly.
What happens if contributions are remitted late?
Surcharges of 2 to 3 per cent per month apply to SSS, PhilHealth and Pag-IBIG, along with potential criminal liability.
Where do I take a dispute?
DOLE for labour standards violations, and the NLRC for dismissal disputes.
