DOLE verifies eight things — and can stop the work

The Department of Labor and Employment is the primary regulator of Philippine employment, and its inspection scope is a useful map of your entitlements.

What DOLE inspections verify

  • Wage payment — minimum wage, overtime, 13th-month, holiday pay
  • Working hours
  • SSS, PhilHealth and Pag-IBIG enrolment
  • Employment contracts
  • Occupational safety
  • Foreign worker documentation

What DOLE can do

  • Compliance orders
  • Work stoppage orders for serious safety violations
  • Administrative fines
  • Public listing of violators
  • Referral to NLRC proceedings for unresolved disputes

The work stoppage power is significant — it is not merely advisory.

The Labor Code does not operate alone. Republic Acts, DOLE orders and agency issuances from PhilHealth, SSS and Pag-IBIG layer additional obligations on top of it.

So a question about your rights may be answered by an agency circular rather than the Code itself.

The bodies the Code created

The Overseas Employment Development Board oversees programmes for Filipino workers seeking work abroad. The National Manpower Skills Center sets competency benchmarks for manpower training.

Labor standards

For a benefit to count as a labour standard, there must be a legal basis for granting it. The standards include 13th month pay, separation pay, retirement pay, and ECC, PhilHealth, SSS and Pag-IBIG benefits — some of which are paid by government rather than the employer.

The DOLE-BWC Handbook

The Handbook on Workers' Statutory Monetary Benefits is the reference document for what employers owe.

Record retention

Employers are advised to maintain employment records, payroll documentation and time records for three to five years.

Where to complain

DOLE for labour standards violations, the NLRC for dismissal disputes.
