What is the minimum retrenchment package in Zimbabwe?
One month’s salary for every two years of service under Section 12C. The ratio is per two years, not per year.
What did the Labour Amendment Act 2023 change?
It redefines retrenchment and introduces the minimum retrenchment package, the enhanced retrenchment package, and capacity to pay.
Who must be notified before a retrenchment?
The works or employment council, the Retrenchment Board, and the affected employees — with 14 days’ written notice including details and reasons.
What is the notification certificate?
A certificate the Retrenchment Board issues confirming compliance. Its absence indicates the process was not completed properly.
What did the 2015 Supreme Court ruling decide?
That employers may terminate by giving three months’ notice without retrenchment costs. A wave of dismissals followed and Parliament has been considering amendments.
What is owed on a notice termination?
Payment of notice and accrued leave. A retrenchment package generally does not apply unless the termination is effectively a disguised retrenchment.
Does poor performance alone justify dismissal?
No. Incapacity on performance grounds requires warnings and support first.
Does accumulated leave form part of a retrenchment package?
Yes, alongside severance and payment in lieu of notice, which makes your leave record financially valuable.
Must my employer negotiate a better package?
Yes. The employer must consult and negotiate any package better than the minimum. If no negotiation took place, the process is defective.
