How much redundancy pay am I entitled to in Australia?
The NES scale runs from 4 weeks at 1 year up to 16 weeks at 9 to 10 years, then drops to 12 weeks at 10 years and beyond.
Why does the redundancy scale drop at ten years?
It is a deliberate feature of the Act, consistent with the 2004 Redundancy Case, relating to long service leave becoming available at that point.
Who qualifies for redundancy pay?
Employees with at least 12 months of continuous service where the employer has 15 or more employees. Casuals and small business staff are excluded.
Do I get both notice and redundancy pay?
Generally yes. They are separate NES entitlements calculated on different scales under different sections.
How much notice am I owed?
One to four weeks by service length, plus an extra week if you are over 45 with at least two years of service. Maximum five weeks.
How long do I have to claim unfair dismissal?
Twenty-one days from the dismissal taking effect, on Form F2 at the Fair Work Commission.
What makes a redundancy genuine?
All three elements of section 389: the role is genuinely no longer required, consultation obligations were met, and redeployment was not reasonable.
What is the compensation cap?
Ninety-five thousand and fifty dollars for dismissals on or after 1 July 2026, or 26 weeks’ pay if lower. It resets each 1 July.
Can my award give me more than the NES?
Yes. Modern awards, enterprise agreements and contracts frequently override NES minimums, including on redundancy.
