How is statutory redundancy calculated in Ireland?
Two weeks’ gross pay for every year of service plus one additional bonus week, with weekly pay capped at €600.
What does the €600 ceiling mean?
The calculation uses €600 even if you earn more, so higher earners receive proportionately less than their actual wage would suggest.
Who qualifies?
Employees with 104 weeks of continuous service, aged 16 or over, in Class A PRSI employment, genuinely made redundant. Part-timers qualify equally.
Is the payment taxed?
The statutory amount is fully tax-free. Ex-gratia top-ups may be partially taxable, with a lifetime cap of €200,000.
When must I be paid?
Within two weeks of your employment ending, following a completed RP50 given at least two weeks before your last day.
What if my employer does not pay?
Serve form RP77. If they are solvent, claim at the WRC within 1 year. If insolvent, apply to the Department of Social Protection.
What are the WRC deadlines?
Six months for most complaints including unfair dismissal, and one year for redundancy-payment disputes, extendable to two for reasonable cause.
Can I lose my redundancy payment?
Yes, if you unreasonably refuse suitable alternative work. But you have a four-week trial period in the new role first.
When is a redundancy unfair?
If it was not genuine, the selection was discriminatory or unfair, or proper procedures were not followed. Pregnancy-related redundancy is automatically unfair.
