How is severance calculated in Botswana?
One day’s basic pay for each completed month during the first 60 months of service, then two days’ basic pay for each completed month beyond that.
Do I get severance if I am on a pension?
No. Severance is payable only where the worker is not registered with the social insurance system. Those receiving a pension or gratuity, or both, are not eligible.
Does my employer need a reason to terminate my contract?
Not a specific stated reason. Either party may end the contract with minimum notice or payment in lieu, except in cases of serious misconduct.
Does a disciplinary procedure still apply?
Yes. Before dismissal other than summary dismissal for serious misconduct, the employer must give notice of the charges and an opportunity to respond.
Is there a national minimum wage?
No single national statutory minimum. Rates are set by sector, with retail trade, domestic service and agriculture differing from the general rate.
What is the standard working week?
Forty-eight hours: a maximum of 9 hours per day on a five-day week or 8 hours per day on a six-day week.
What happens to leave I did not take?
You are entitled to payment in lieu of untaken statutory annual leave, separately from notice pay and any severance.
What deductions can my employer make?
Only amounts authorised by law or by written agreement, such as loan repayments or uniforms owed.
Can my contract give better severance than the law?
Yes. The statutory formula is a minimum, and some contracts provide more generous terms.
