Frequently asked questions
How much gratuity am I entitled to in Zambia?
Not less than 25% of your basic pay earned during the contract period, under section 73(1), for long-term contracts exceeding twelve months.
Who is exempt from statutory gratuity?
Expatriate employees, those in the agricultural and domestic sectors, and management employees whose written contracts already provide for gratuity.
Does the Employment Code apply to me?
Only if you were contracted after 9 May 2019. Employees hired before that date remain under the previous law, where gratuity was generally discretionary.
How long is probation?
Three months, extendable once for a further three months.
What must an employer do after a summary dismissal?
Report it to the Labour Officer of the district within four days, under section 50(2). It is frequently overlooked.
How is leave pay calculated?
Salary multiplied by the number of leave days, divided by twenty-six. A calculation using 30 produces a lower figure.
Why is redundancy pay treated differently?
Because it carries a substantial income tax exemption, reported at K2,000,000, that does not attach to every terminal payment.
Are casual employees entitled to severance?
No. Casual and temporary employees are not entitled to severance pay under the Employment Code.

The Labour Officer for your district, under the Ministry of Labour and Social Security.
