Who gets statutory termination benefits in Malaysia?
Covered employees — those earning up to RM4,000 monthly, plus manual labourers, their supervisors, commercial vehicle operators, domestic employees and certain seagoing positions.
What is the termination benefit formula?
Ten days’ wages per year under 2 years, 15 days per year for 2 to 5 years, and 20 days per year for 5 years or more.
What if I earn above RM4,000?
The overtime and termination benefit sections of the Act do not apply. Both come from your contract or company policy instead.
How much notice am I owed?
Four weeks under 2 years, 6 weeks for 2 to 5 years and 8 weeks over 5 years, applying whether the employer or employee initiates.
How long do I have to claim EIS?
Sixty days from the date of loss of employment, subject to the Contributions Qualifying Conditions.
How long do I have to challenge a dismissal?
Sixty days from termination under the Industrial Relations Act 1967. It is a separate process from the EIS claim.
What are the EPF rates?
Employer 13% for employees earning up to RM5,000 or 12% above, and employee 11%. Foreign workers contribute 2% each from October 2025.
Can I request flexible working?
Yes. The 2022 amendments introduced a statutory right to request flexible arrangements on hours, days or location.
Do the same rules apply in Sabah and Sarawak?
No. Employees there are covered by separate state ordinances rather than the Employment Act 1955.
