Malaysian contracts work differently depending on which side of RM4,000 you sit.
Below RM4,000
You have statutory overtime and statutory termination benefits under the Employment Act. The contract can improve on them but cannot reduce them.
Above RM4,000
Those two sections do not apply. Overtime and severance come from your contract or company policy instead.
Which makes negotiating them at offer stage significantly more important.
Written contracts are mandatory
Employers must provide written contracts to employees employed for more than one month.
Mandatory provisions:
- Job title and duties
- Salary and benefits
- Working hours
- Leave entitlements
- Probation period
- Notice periods
- Termination conditions
- EPF, SOCSO and EIS contributions
The Act requires contracts exceeding one month to include, as a minimum, a clause setting out how the contract may be terminated by either party.
No written contract?
The absence of one does not automatically mean no employment relationship exists. It means the employer failed an obligation — which works in your favour, not against you.
