What is the Portable Retirement Gratuity Fund?
A fund under the Workers’ Rights Act 2019 that pays a gratuity on death or retirement, recognising your service irrespective of how many employers you have had. Employers contribute 4.5% of monthly remuneration.
Who is excluded from the PRGF?
Employees under the Statutory Bodies or Sugar Industry Pension Fund Acts, those under a certified private pension scheme, and those with a monthly basic above MUR 200,000.
What is the MUR 50,000 threshold?
The Workers’ Rights Act 2019 generally applies to workers earning up to MUR 50,000 monthly, raised from MUR 30,000 under the previous Act.
What applies if I earn above the threshold?
Provisions on discrimination, end of year bonus, maternity and paternity leave, juror’s leave and leave for international events still apply regardless of salary.
How is severance calculated?
On the higher of the last complete month’s remuneration or a monthly rate over the previous 12 months, including extra work, bonuses, commission and other regular payments.
What does the Redundancy Board do?
It examines whether a workforce reduction was justified. Where unjustified, severance is three months’ remuneration per year of service, or reinstatement with the worker’s consent.
Can my severance be reduced?
Yes, where the employer has granted a gratuity or contributed to a fund or scheme, including the PRGF. Ask for the deduction to be itemised.
What if my private pension scheme fails to pay?
The employer must pay a lump sum equivalent to 15 days’ remuneration per year of service.
When do I get my annual tax statement?
Employers must provide a statement of tax deductions and payments before 15 August each year.
