How is severance calculated in Antigua and Barbuda?
At least one day’s basic pay for each month of service under the Labour Code, counted by month rather than by year, after one year of continuous service.

Guidance differs substantially between sources. The per-month formula appears in sources citing the Labour Code directly, but confirm with the Labour Department.
Is Antigua and Barbuda an at-will jurisdiction?
No. Termination must be for just cause such as misconduct, or on operational grounds such as redundancy.
What is the 21-day cooling-off period?
A window for contested dismissals during which the Department of Labour may intervene. Act within it rather than after.
Is there personal income tax?
No. Take-home pay is affected only by social security at 16% total and medical benefits at 7% total.
Does social security cover unemployment?
Yes, alongside retirement pensions and sickness and maternity benefits, which many Caribbean systems do not provide.
Is a written contract required?
Yes. The Labour Code mandates written contracts detailing leave, hours and probation.

Missing records create presumptions in favour of employee claims. Employers must retain them for three years after employment ends.
