What the Labour Officer considers

Where the parties cannot agree, the amount is determined based on:

  • Length of service
  • Wages
  • The circumstances of the termination

Each of those is something you can evidence.

What to bring

  • Proof of your start date — appointment letter, first payslip, anything dated
  • Payslips across your service, showing wage progression
  • The written notice and its stated reason
  • Evidence of the circumstances — restructuring announcements, closure notices, correspondence
  • Any collective agreement covering your role
  • Records of your NSSF contributions

Why the circumstances matter

Because the Act lists several distinct situations that trigger severance — employer termination, redundancy, insolvency, unfair termination — and they are not equivalent.

A termination that followed no lawful procedure is a different circumstance from a genuine restructuring, and the Officer can take that into account.

Negotiate first

The Act contemplates negotiation between the employer and the worker, or the union representing them. That is your first opportunity, and agreement there avoids the Officer route entirely.

If a union covers your workplace, involve it — collective bargaining agreements may provide expressly for severance or redundancy pay.

The leverage you have

An employer who fails to pay on time and in the prescribed manner faces a fine of twice the amount payable.

That penalty is worth mentioning in negotiation, because it makes delay expensive for the employer.
