When employment ends in Belize, the Labour Act requires that all wages due are payable immediately.

What should be included

  • Notice pay — where notice was not given and worked
  • Vacation pay — where you have earned vacation not yet used or paid
  • Outstanding wages
  • Severance pay — only where you have at least five years of service

The relevant provisions include section 37 on notice, sections 128 and 130(1) of the Labour Act and sections 12 and 15 of the Shops Act on holiday pay, and section 96 on payment of wages.

The expensive assumption

Many employers assume severance pay covers the notice period. It does not.

Both are owed separately, which effectively doubles the expected cost of a termination for employees with over a year of service.

If your settlement shows one figure covering both, question it.

The severance checklist

  1. Do you have five years of continuous employment? Below that, severance does not arise.
  2. Which band applies — one week per year for five to ten years, or two weeks per year above ten?
  3. Does your service cross 1 May 2011? If so, the calculation splits.
  4. Is severance being offset against a pension? Per the 2025 CCJ ruling, it generally cannot be, unless the plan specifically accounts for it.

Social Security must be current

Contributions must be current through the final pay period. Check your SSB record before you sign anything.

Deductions

Only SSB, income tax and deductions with your written consent are lawful.

If payment is delayed or wrong

Negotiate with the employer first. If unresolved, file a complaint with the Ministry of Labour, which will investigate and may act against the employer.

As a final step, legal action or a Labour Tribunal claim is available for unlawful termination or delayed wages.

Your written statement of terms, payslips, evidence of your start date and the settlement calculation.
